Meeting on Formation of Residents Association & Joint Management Bodies

The committee had a meeting with the Management company, Fadzilah & Fikri  Sdn. Bhd.(FFMS) and representatives from Sentosa Restu (Talam),  IJM Construction (main contractor) and Contramec Sdn. Bhd.  (sub-contractor) on the 24 February, 2011..

Out of the 300+ defect complaints lodged with the Management company only 40 defect complaints were attended to and rectified. Is this how a developer handles defect rectification? This does not reflect any degree of concern on the part of the developer. The vacant possessions were handled over  to the owners/purchasers three months ago. Many owners or tenants have already moved in. Can they live with main door that cannot be locked or jammed? Can they stay with blocked toilet sewage pipes? These are very minor defects that can be resolved easily with just a handyman.

Tired of complaining, I engaged my own locksmith to repair the main door lock. It is Only a 20 minutes job to rectify careless installation that caused the lock to jam up. Even sewage pipe blockage can be cleared fairly easily. Why nothing is being done?
This just shows their “could not care less” attitude (tidak apa) of the developer, at the expenses of the owners/purchasers.

 Sentosa Restu brought in the other parties (their contractors and sub-contractors) into the meeting. As far as the owners/purchasers are concerned, these other parties are irrelevant. The only party who is responsible is the developer, i.e Sentosa Restu (Talam)

Whatever problems the other parties (all the contractors) encountered with Sentosa Restu have to be resolved amongst themselves and has othing to do with the owners/purchasers. The buck stops there.

Contramec Sdn. Bhd (sub-contractor) representative has informed the meeting that he will give an undertaking by next week on the scheduled completion of all the defect complaints. Management company and Sentosa Restu must follow up and advise the owners/purchasers accordingly.

We are calling all owners and residents to come forward to form the Residents Association and subsequently the Joint Management Bodies(JMB). The JMB is a requirement under the “Building and Common Property (Maintenance & Management) Act 2007. The JMB will jointly manage the entire complex. JMB can ignore the developer, if they remain recalcitrant in fulfilling their obligations. The RA and the JMB can also explore and initiate legal actions against the developer and also, where possible, lift the corporate veil of Sentosa Restu and go after the directors of Sentosa Restu (M) Sdn. Bhd in their personal capacities by citing them for contempt of Court Order and abuse of the process of law.

On the issues of nuisance created by the African nationals, the RA and JMB can also initiate legal action against the owners (for letting their premises to the African) and tenants for creating the nuisance. They are disturbing the ladies, the peace of the environemnt  and loitering around the Komplek in groups that created an environment of fear among the residents. Under the common law of property, every owner or resident owes a duty of care to his/her neighbour. The word “neighbour” here means every person in Komplek Suria Kinara. Know your rights and we shall act together collectively.


So, please help get all the owners or residents to come for the meeting scheduled on 20 March 2011. The notice has been emailed to owners with contacts given to the Management office and submitted to this Blog.

Notice will also be inserted into your letter box at the ground floor lift lobby area at the respective blocks. If you failed to get the notice, please contact the Management office.

Please help to contact other  owners/residents who have not given their e-mail address to the management office and to send their e-mail address to me for inclusion in the mailing list. Sentosa Restu (M) Sdn. Bhd. (Talam Group) is not giving enough attention in resolving the defect issues and also not co-operating with the committee in providing us the full list of owners contacts.

Garbage Disposal and Security.

What a sorry and ugly sight?

All the owners of Suria Kinrara and the developer have been paying Municipal Assessment (local government tax) to Majlis Perbandaran Subang Jaya.(MPSJ). Presumably, Sentosa Restu (M) Sdn. Bhd. is paying the tax . Who is irresponsible and not doing their job?

The certificate of Fitness for Occupation of Komplek Suria Kinrara was issued by MPSJ in late 2010. And if the tax is paid accordingly, why is MPSJ not collecting the garbage from the  central garbage bins in the Komplek?  Something is amiss here.

Is this how an apartment central garbage house
should look like?
All Owners are required  to pay RM1,000.00 deposit for renovation.
Thereafter, an administrative charges of RM50.00 is deducted.
Why nothing is done to get rid of this?
Not only one garbage house is full, The second one
is also spilled onto the road.
I have asked the Management Corporation of the Komplek but was given an illogical and unacceptable answer. Then, what is the Management Corporation doing to resolve this garbage problem?  Cann’t they get a garbage contractor to get rid of them? The garbage need not go to a far away dumpsite. Just transfer them to another central collection point where MPSJ will remove them. At least this is a temporary solution. Can they do this simple task?

A common garbage bin is placed at each of the eight lift lobbies. There are quite a number of the apartment units being occupied and there are perishable garbage in the communal garbage bins. These bins should be clear everyday. But this is not the case.
A few of the lift lobbies at all the four blocks stinks.

The Court Sanctioned card access system not in operation.
It is already three months since the vacant property was handed over to the buyers. Where is the security system? The apartment car park’s automated access system was arranged under the Court Sanctioned Scheme. Up to now, the system is still not operating. What is going on? The Management Corporation must given a definite answer during the next meeting.

Where is the guard who is on duty here?
The guard who is stationed at the entry point to the apartment car park ramp is missing ocacssionally. Isn’t this a lapse of security procedures?

The access door to the apartment’s lift lobby is still nowhere to be seen. What is the problem?

Cars without residents’ stickers can be seen in the parking lots.

Inconsiderate residents are using the common corridors and the lift lobby areas as their private property, to hang their laundries. Laundry racks and shoe racks are found at some of the lift lobby areas.

If the Management Corporation is not strict and firm in addressing al these issues in the buds, the whole Komplek will degenerate into a slum-like environment. I hope this will not happen. Otherwise, this will turn into a ghost-like building after a couple of years.
